Understanding Divorce Law in Australia

Divorce in Australia is a legal process governed by the Family Law Act 1975 and you must have been separated for more than 12 months before you can become divorced. Unlike other jurisdictions such as the United States, divorce in Australia is ‘no fault’, meaning blame is taken away from the process.

In Australia, we also separate divorce from other family law matters such as parenting and/or property matters.

How the Divorce Process Works in QLD

You may contact a divorce lawyer, who is specifically allowed to appear as a legal representative in the Federal Circuit and Family Court of Australia.

Your divorce lawyer collects the appropriate documents and information from you, then prepares your application for divorce.

Once your application for divorce is complete, it is signed and filed with the court, along with the necessary accompanying documents which include your marriage certificate.

A divorce hearing is scheduled for a future date (usually not too far away).

The filed documents are then served personally on your ex, usually by a process server.

Often there is no need for either you or your ex, or even your divorce lawyer, to appear at the divorce hearing, though sometimes an appearance is necessary.

So long as everything is in order, at the divorce hearing the court will declare that your marriage has finally ended then a month and one day later a divorce order will be issued.

What Happens After Divorce?
(Children, Property & More)

It is always a good idea to attend to parenting arrangements and property settlement matters before you file an application for divorce, however if you don’t then that doesn’t mean that a divorce order will not be issued.

If you become divorced and you have not yet finalised property settlement matters with your ex, you and your ex then have 12 months in which to make an application to the court for property settlement matters. This is one reason why it is important to receive advice from a divorce lawyer early after separation.
