How the Divorce Process Works in QLD
You may contact a divorce lawyer, who is specifically allowed to appear as a legal representative in the Federal Circuit and Family Court of Australia.
Your divorce lawyer collects the appropriate documents and information from you, then prepares your application for divorce.
Once your application for divorce is complete, it is signed and filed with the court, along with the necessary accompanying documents which include your marriage certificate.
A divorce hearing is scheduled for a future date (usually not too far away).
The filed documents are then served personally on your ex, usually by a process server.
Often there is no need for either you or your ex, or even your divorce lawyer, to appear at the divorce hearing, though sometimes an appearance is necessary.
So long as everything is in order, at the divorce hearing the court will declare that your marriage has finally ended then a month and one day later a divorce order will be issued.
